Care

Neoprene products can be hand washed with a mild detergent in cold water.

To avoid water ring stains, don’t just spot treat. Instead, hand wash your neoprene bag by applying a mild soap directly onto the stain. Fully submerge the entire bag in cold water (yep, dunk it), then gently work the stain and soap out to make sure there’s no lingering residue.

Make sure to reshape while wet and lay flat to dry on a clean, non-porous surface. Avoid treated or dyed materials, as well as direct sunlight.

Hardware should be handled delicately. Neoprene products are not machine washable, as hardware chipping may occur.

Due to the nature of neoprene, creasing and pilling may occur and is easily remedied. To avoid creasing, neoprene products should not be stored flat or under heavy compression. Creases can be easily removed by running a fabric steamer in downward strokes along the fabric. Pilling can be removed using a fabric shaver. Lightly press and move in a circular motion against the fabric to remove any fuzz balls and pills.

Avoid harsh solvents such as alcohol, acetone, and oil, which could harm the exterior of your bag.

INFORMATION COLLECTED BY COOKIES

INFORMATION COLLECTED BY WEB BEACONS

In addition to cookies, Dagne Dover employs "invisible pixels" (a.k.a. web beacons) on the Site and in connection with certain email communications. An invisible pixel is a tiny, 1x1 image that is loaded when you visit a Site, but instead of calling up an image, it causes a cookie or application to be downloaded. Pixels and other web beacons can be used for a number of web tracking or advertising purposes, however, the web beacons implemented on the Dagne Dover Site are limited to the anonymous tracking of Site usage patterns. Additionally, Dagne Dover uses Web Beacons to anonymously track whether certain email communications are opened by recipients.

SERVER LOGS

Dagne Dover’s servers automatically record certain information from your web browser whenever you visit the Site. These server logs include information such as your Internet Protocol ("IP") address, browser type, browser language, referring pages (including URLs), platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, and the date and time of any requests you make while navigating the Site. The information collected in the server logs is not personal information and cannot be used to personally identify you. While the server logs are associated with your IP address in order to track specific browsing sessions on the Site, Dagne Dover does not store or associate the information in the server logs—including your IP address—with your account or contact information.

Dagne Dover takes reasonable technical and organizational precautions, in addition to following industry best practices, to protect your information against loss, misuse, alteration, disclosure, unauthorized access, or destruction.

Dagne Dover makes use of Secure Sockets Layer (SSL) technology and keeps sensitive details stored in an encrypted format in the Dagne Dover database. If you provide your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with AES-256 encryption. By consenting to participation in the Service, you agree to receive recurring SMS/text messages or prerecorded mobile marketing messages from and on behalf of Dagne Dover through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Messages may include checkout or incomplete job application reminders. Text messages may be sent using an automatic telephone dialing system (“ATDS” or “autodialer”) or other technology. While you consent to receive messages sent using an autodialer, the foregoing shall not be interpreted to suggest or imply that any or all of our mobile messages are sent using an ATDS. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for the Service in order to make any purchases, and your consent is not a condition of any purchase with Dagne Dover. Your participation in the Service is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

If you do not wish to continue participating in the Service, you may opt-out at any time. Text the single keyword command STOP to 59247 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Dagne Dover mobile message programs (to the extent such programs are offered) and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the Service with your new number.

The Service is offered on an "as-is" basis and may not be available in all areas at all times and may not continue to work in the event of product, software, coverage, or other changes made by your wireless carrier. To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service. Delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator and is outside of our control. Carriers are not liable for delayed or undelivered mobile messages.

We endeavor to comply with the Florida Telemarketing Act and the Florida Do Not Call Act as applicable to Florida residents. For purposes of compliance, you agree that we may assume that you are a Florida resident if, at the time of opt-in to the Service, (1) your shipping address, as provided is located in Florida or (2) the area code for the phone number used to opt-into the Service is a Florida area code. You agree that the requirements of the Florida Telemarketing Act and the Florida Do Not Call Act do not apply to you, and you shall not assert that you are a Florida resident, if you do not meet either of these criteria or, in the alternative, do not affirmatively advise us in writing that you are a Florida resident by sending written notice to us. Insofar as you are a Florida resident, you agree that mobile messages sent by us in direct response to mobile messages or requests from you (including but are not limited to response to keywords, opt-in, help or stop requests and shipping notifications) shall not constitute a “telephonic sales call” or “commercial telephone solicitation phone call” for purposes of Florida Statutes Section 501 (including but not limited to sections 501.059 and 501.616), to the extent the law is otherwise relevant and applicable.

Dispute Resolution. In the event that there is a dispute, claim, or controversy between you and us, or any other third-party service provider acting on our behalf to transmit the mobile messages within the scope of the Service, arising out of or relating to federal or state statutory claims, common law claims, these Mobile Terms, or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of these Mobile Terms to arbitrate, such dispute, claim, or controversy will be, to the fullest extent permitted by law, determined by arbitration in New York, NY before one arbitrator.

The parties agree to submit the dispute to binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) then in effect. Except as otherwise provided herein, the arbitrator shall apply the substantive laws of the State of New York, without regard to its conflict of laws rules. Within ten (10) calendar days after the arbitration demand is served upon a party, the parties must jointly select an arbitrator with at least five years’ experience in that capacity and who has knowledge of and experience with the subject matter of the dispute. If the parties do not agree on an arbitrator within ten (10) calendar days, a party may petition the AAA to appoint an arbitrator, who must satisfy the same experience requirement. In the event of a dispute, the arbitrator shall decide the enforceability and interpretation of this arbitration agreement in accordance with the Federal Arbitration Act (“FAA”). The parties also agree that the AAA’s rules governing Emergency Measures of Protection shall apply in lieu of seeking emergency injunctive relief from a court. The decision of the arbitrator shall be final and binding, and no party shall have rights of appeal except for those provided in section 10 of the FAA. Each party shall bear its share of the fees paid for the arbitrator and the administration of the arbitration; however, the arbitrator shall have the power to order one party to pay all or any portion of such fees as part of a well-reasoned decision. The parties agree that the arbitrator shall have the authority to award attorneys’ fees only to the extent expressly authorized by statute or contract. The arbitrator shall have no authority to award punitive damages and each party hereby waives any right to seek or recover punitive damages with respect to any dispute resolved by arbitration.

THE PARTIES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY VIA ARBITRATION AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ARBITRATION PROCEEDING.

Further, unless both parties agree otherwise in a signed writing, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

Except as may be required by law, neither a party nor the arbitrator may disclose the existence, content, or results of any arbitration without the prior written consent of both parties, unless to protect or pursue a legal right. If any term or provision of this section is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Section or invalidate or render unenforceable such term or provision in any other jurisdiction. If for any reason a dispute proceeds in court rather than in arbitration, the parties hereby waive any right to a jury trial. This arbitration provision shall survive any cancellation or termination of your agreement to participate in the Service.

You warrant and represent to us that you have all necessary rights, power, and authority to agree to these Terms and perform your obligations hereunder, and nothing contained in these Mobile Terms or in the performance of such obligations will place you in breach of any other contract or obligation. The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder. If any provision of these Mobile Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Mobile Terms will otherwise remain in full force and effect and enforceable. Any new features, changes, updates, or improvements of the Program shall be subject to these Mobile Terms unless explicitly stated otherwise in writing. We reserve the right to change these Mobile Terms from time to time. Any updates to these Mobile Terms shall be communicated to you. You acknowledge your responsibility to review these Mobile Terms from time to time and to be aware of any such changes. By continuing to participate in the Program after any such changes, you accept these Mobile Terms, as modified.

Warranty Disclaimer and Limitation of Liability

YOU AGREE THAT YOUR USE OF THE WEBSITE SHALL BE AT YOUR SOLE RISK, AND THAT THE WEB SITE AND ALL CONTENT INCLUDED THEREIN, AND PRODUCTS PURCHASED THEREBY, ARE PROVIDED TO YOU “AS IS.” TO THE FULLEST EXTENT PERMITTED BY LAW, DAGNE DOVER PARTIES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE WEBSITE, YOUR USE THEREOF AND THE PRODUCTS PURCHASED THEREBY. Miscellaneous

You agree that the Web Site shall be deemed a passive service based solely based in New York and shall not give rise to personal jurisdiction over Dagne Dover, either specific or general, in jurisdictions other than New York, except as provided in the Privacy Policy. These Terms of Service shall be governed by the internal laws of the State of New York, without regard to its conflict of laws principles, except as provided in the Privacy Policy. Any claim or dispute between you and Dagne Dover that arises in whole or in part from the Web Site shall be subject to the exclusive jurisdiction of the federal and State courts located in New York, New York. These Terms of Service, together with the Privacy Policy and any other legal notices published by Dagne Dover on the Web Site, constitute the entire agreement between you and Dagne Dover concerning the Web Site. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NO CLAIM UNDER THESE TERMS OF SERVICE SHALL BE JOINED TO ANY OTHER CLAIM, INCLUDING ANY CLAIM INVOLVING ANY OTHER CURRENT OR FORMER USER OF THE WEB SITE, AND NO CLASS ACTION PROCEEDINGS SHALL BE PERMITTED. Most communications between Dagne Dover and you will be sent and received electronically. You agree that all agreements, notices, disclosures, and other electronic communication exchanged between you and Dagne Dover shall satisfy any legal requirements that such communications be in writing.

Return Policy

We accept returns on unused products within 30 days of shipment for orders shipped within the US. However, if something went wrong upon arrival or initial use, please let us know at support@dagnedover.com.

All US returns are subject to a $10 handling fee. If you are returning items from multiple orders, they must be shipped separately. We do not provide shipping labels for international orders. We do not accept returns or exchanges on final sale items.

Any return made on an order with a total value of $1,000 or more will be processed upon receipt and inspection at our return facility, not at the time of shipment or delivery.

When you submit a photograph in connection with Dagne Dover’s customer loyalty program, you retain your rights to your photograph. However, by submitting a photograph, you grant Dagne Dover (and those authorized by Dagne Dover) a royalty-free, worldwide, perpetual , non-exclusive, transferrable, and sublicensable license to publicly display, distribute, reproduce, and create derivative works of the submitted photograph, in whole or in part, in any media now in existence or later developed, for any purpose, including but not limited to, advertising and promotion of Dagne Dover, its website, social media pages, and commercial products. You also agree to irrevocably waive all right of integrity and any other rights to the photograph under Section 106A of the Copyright Act, commonly known as “moral rights,” and, to the extent this waiver is not permitted by applicable law, you agree not to enforce any such moral rights against Dagne Dover or any individual or entity it authorizes to receive copies of the photograph. Any photograph reproduced will include a credit to you and/or your social media username as feasible. Photographs distributed by Dagne Dover on social media may also grant the respective social media platform a license to use the photographs, as described in further detail in each platform’s respective terms of service.

You also grant us the right to use your name, image, likeness, biographical information (if provided), social media username (if provided), and any other information about you that you provide in connection with your submission of a photograph or the creation and maintenance of your customer loyalty account in connection with the photograph and any derivative works created of the photograph for any purpose, including but not limited to, advertising and promotion of Dagne Dover, its website, social media pages, and commercial products.

By submitting a photograph, you represent and warrant that you are at least eighteen (18) years of age and have the full right, power, and authority to enter into this agreement and grant the above license and rights. If the photograph incorporates any person other than yourself, you represent and warrant that you have obtained the permission of each represented person to submit the photograph and to grant the license, rights, and waivers described above on their behalf. You further represent and warrant to Dagne Dover that I will provide only true and correct statements and other information in connection with my submission (including but not limited to the fact that the Dagne Dover products depicted are my own and any opinions expressed about such Dagne Dover products are current, accurate, and truthful and made of your own free will), and that Dagne Dover and its licensee’s use of the photograph and the rights and licenses you grant do not, and will not, violate any intellectual property right (including, without limitation, copyright, trademark, right to privacy, or right of publicity) of, or conflict with or violate any contract with or commitment made to any person or entity and that no consent or authorization from, or any payment to, any third party is required in connection with the submitted photograph. You further agree to defend, indemnify, and hold harmless Dagne Dover and its licensees from and against all claims by third parties resulting from your breach or alleged breach of this agreement or any of these representations and warranties.

Dagne Dover will not be required to pay any additional consideration, royalty, payment, or other compensation or to seek any additional approval from you in connection with the license and rights granted or permitted uses described above.
